Terms and Conditions
Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions. Your placement of an order indicates your acceptance of these terms and conditions. Your submittal of any purchase order to Computer Gate indicates acceptance of these terms and conditions. These terms and conditions shall supercede any subsequent terms and conditions included with any purchase orders, whether or not such terms or conditions are signed by Computer Gate. Computer Gate reserves the right to make changes to this site and these terms and conditions at any time.

Placing Order
To streamline your purchase and eliminate the waiting time on the phone, all orders and pricing shall be made through the Internet. The pricing on the Internet is a real time pricing. 

International Order
We accept international orders only if the orders meet all of the following terms and conditions.

Payment Method
You may order products through this on-line store using VISA, MasterCard, Discover and American Express.  To protect our customers against unauthorized charges, credit card orders that are shipped to addresses other than your billing address will require additional verification.  All credit card orders are subject to verification and approval. Orders use different shipping address or order amount exceeds $500 may require Credit Card Authorization Agreement. For faster service, please download (.doc) or download (.pdf), fill out the Credit Card Authorization Agreement form and fax to us at (408) 730-0735. For open account information and overseas customers, please contact our Customer Service Department.  Hard copy PO with valid PO number is required for all term customers.

Sales Tax
Computer Gate shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within California. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

Shipping and Handling
Orders are usually shipped within 2 business days. Occasionally, orders may take up more than 3 business days for shipment depending on the availability. Standard shipping is UPS Ground.  FedEx 2-day and overnight services are available. Computer Gate will add a $2.95 handling charge per order with an exception $5.00 handling charge per order for all Post Office shipment. Shipping and handling fees are non-refundable.  All sales are FOB Santa Clara, CA.  

Back Ordered Items
When products are back-ordered the following will apply:
1. If the back ordered product is scheduled to reach Computer Gate warehouse
    within five (5) business days, your order will be on hold in order to complete
    your shipment.
2. If a back ordered product will be out-of-stock more than 5 business days or
    has been discontinued, a credit will be issued and our sales representative will
    inform/contact you about this matter.

Damaged Merchandise
You must report all damaged merchandise to carrier (UPS, FedEx or Post Office) and send Computer Gate a copy of the inspection report.  It is important that you request the carrier to contact Computer Gate at (408) 730-0673.  We reserve the right to replace damaged parts or entire product.  A $30 re-boxed fee will be assessed for any product returned in a damaged box.  Please examine all  merchandise before assembling.  Computer Gate will not accept any merchandise back that has been assembled or attempted to be assembled.

Returns and Refunds
Your satisfaction is guaranteed with any products purchased from Computer Gate online within thirty (30) days of the invoice date. If you are not satisfied with the products you can exchange or refund them within 30 days.
All products returned to us must be accompanied by a Return Merchandise Authorization (RMA). Contact our customer service department to obtain an RMA number or you can request a RMA number by submitting the form online. 
We need this information in order to issue an RMA:
(1) Order number or invoice number (on your original invoice)
(2) Computer Gate's part number and quantity.
(3) Serial number for the return item.
(4) Reason for return.
(5) Your Customer ID, Name, Phone/Fax #, Email address.
All RMA numbers issued are good for fifteen (15) days from the date of issue. Prepaid shipping is required for all returning products. A copy of your original invoice is required to process your return. Returned merchandise must be in original, new, re-sellable condition and be accompanied by all original packaging, documentation and accessories. Therefore please check carefully the packaging and label to make sure you receive the correct product and version. In all cases, returned products must be shipped prepaid with an approved RMA number clearly shown on the shipping label. 
Shipping and handling are not included in the refund. Computer Gate reserves the right to refuse merchandise or impose a minimum of 15% restocking fee for any returns not meeting the above requirements. There is no price protection on all our products; as you know prices fluctuate daily in the computer business, just like the stock market. In order for Computer Gate to keep the best price for our customers, we cannot accept product return because of the price fluctuation.

Warranty Disclaimers/ Limitation of Liability
Computer Gate  expressly disclaims all warranties either expressed or implied, including any implied warranty of merchant ability or of fitness for a particular purpose.   Computer Gate shall have no liability to anyone for incidental or consequential damages or any other liability, loss or damage arising out of or related to the merchandise, even if Computer Gate or a Computer Gate authorized representative has been advised of the possibility of such damages.  All merchandise sold "As is ".  Computer Gate makes no warranty as to the performance of any merchandise sold.  Computer Gate is not responsible for system downtime, lost data or any other damages.  This disclaimer by Computer Gate in no way affects the terms of a manufacturer's warranty, if any.

Typographical and Misprinted Errors
We are not responsible for typographical or pictorial errors and make every possible effort to avoid them.  We reserve the right to change or correct prices or substitute products and manufacturers.  Item picture may be representative items only!  Specifications and descriptions subject to change without notice.
